Thomson’s The India Contract Act, 1872 by Justice S.D. Dave – 1st Edition 2023. When a litigant approaches the Court for the redressal of his grievances related to a contract or relations resembling those created by contract, he is required to establish a contract or such relations, either scripted or oral, and bears the burden of proving the same. He is required to prove free consent of the parties, competent to contract, and the object not being expressly declared to be avoid. The responsibility, later, falls on his Counsel to convince the Court. The task of the Counsel would be less demanding if he finds himself assisted by precedents.
