ABOUT THE BOOK

Many books have been written on Islamic law but the majority of those endeavored during the British period. Therefore, it is inevitable that the colonial lens might have been imputed to the works on Islamic law published before independence. As most of the jurists who attempted to understand Islamic law have a preconceived notion about the Muslim law because of them being British educated, they mostly relied on western jurists, rather than the jurists of the Indian subcontinent. They tried to look at Muslim law through the western perspective which was prejudiced and they tried to interpret it in harmony with the western law, therefore, ultimately deviating from the true spirit of Sharia.

In modern times, when there is such a hullabaloo about reform in Islamic law, it is our duty to take recourse to the works of Muslim jurists born in the Indian subcontinent who have enriched Islamic law by placing primary reliance on original Islamic texts rather than secondary sources. The book deals with the study of Islamic law through the works of two great jurists born in the Indian subcontinent, during early twentieth centurynamely, Shibli and Maulana Thanvi.

ABOUT THE AUTHOR

The author is Professor at the Indian Law Institute, New Delhi. He has studied law in Lucknow, Aligarh, and Delhi. His subjects of specialization are Islamic Law and Environmental Law and has about 30 years’ experience of teaching and research in the legal field. He has written books on family law, environmental laws and Human Rights including acclaimed works like Triple Talaq: An Analytical Study with emphasis on Socio-Legal Aspects (1984), Legal Regulation of Hazardous Substance (2009) and Human Rights in India (2011). He has also contributed several articles in national and international journals. He has presented papers at both National and International conferences and seminar. He recently presented a paper on “The Principles of Fiqh & Issues in Advanced Medical Science- A Contemporary Challenge from the Indian Perspective” at International Seminar on Islamic Jurisprudence in Contemporary Society, in the University of Sultan Zainal Abidin, Terengganu, Malaysia on 4-5th March 2017. The Calcutta University awarded prestigious “Suparbhadeb medal” for one of his writings published in the Journal of Indian Law Institute titled “Origin and Growth of Environmental Law in India”. Recently, he was awarded with “Best Professor in Law” at the 24th Business School Affaire & Dewang Mehta National Education Awards, organized by Dewang Mehta Foundation, Mumbai on 25th November, 2016.
