This volume is the first systematic study of the Code of Civil Procedure jurisprudence of Justice R. C. Lahoti, the thirty-fifth Chief Justice of India, drawn from his decisions across his tenures at the Madhya Pradesh High Court, the Delhi High Court and the Supreme Court of India between 1988 and 2005. Organised thematically into twenty-one chapters across four Parts: Institution and Pleadings, Trial and Interim Relief, Execution, and Appeal, Revision and Review. The book reads his Lordship's procedural decisions not as a chronological catalogue but as a coherent body of doctrine.
Each chapter sets out the relevant provisions of the Code as in force, traces the doctrinal framework within which his Lordship worked, analyses every reported decision authored by him on the chapter's theme, and closes with a synthesis of the working principles that emerge. Subsequent Supreme Court restatements are noted in the footnotes, so that the reader is carried forward to the position as it stands today.
Drawing on more more two hundred fifty Supreme Court judgments and a substantial body of High Court decisions, the work will be of value to the Bar, the Bench, the academy and senior students engaged with the working of the Code in everyday civil practice.
